These pages, the content infrastructure of these website pages, mobile apps and online trading service provided through the webpages and mobile apps are owned, operated and serviced by FALCA solutions for agricultural commodities trading activities as ruled and monitored by FALCA Solutions. These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly made available online. By accessing or using our services you agree to be bound by these terms. If you disagree with any part of the terms then you may not access the service. The farmer or any other third party related to the farmer is ought to abide by the rules/procedures set by FALCA for online marketing through this portal. FALCA may not or will not force/pressurize the farmer to sell and consumer to buy the goods through FALCA platform. The order placement, the quantity, quality and prices quoted by the farmer is solely at his/her discretion. The quantity, quality and prices quoted by the consumer is based on the consumer’s requirement and capacity to purchase, and solely by the consumer at his/her discretion.

FALCA Solutions is only a quality, transport and marketing facilitator with guarantee to both the parties in agreement. The commodities that are placed online on FALCA Solutions for trading by you (the farmer, any seller) are subjected to locality check, quality check, grades check, packaging check, volume check, certification check, and other parameters as specified by the consumers and FALCA . The farmer, the owner or any other third party related to the owner of the commodities is ought to cooperate and support the FALCA representatives in carrying out the necessary QC and other parameters confirmation as specified by FALCA and consumer. Farmer or the commodity owner has any reservations or concerns, should talk to FALCA representative in the field amicably to sort out them in the field itself or can call FALCA to get more information on the concerns and raise the issues.Farmer or owner of the commodities should bear the packaging charges, or if FALCA takes care of packaging then farmer or owner of the commodities are liable to pay the same towards FALCA , and FALCA will make necessary deductions during the payment.

Auction, Bidding and Payments

Once the commodities were auctioned, bidding accepted and payments made to farmer or owner of the commodities, he or she or any others related to first party do not have any ownership on the commodities. Then FALCA will be the sole owner those commodities until its reached to concerned customers. Once commodities were auctioned as per FALCA procedures, and commodities have been loaded and ready for transportation, if there is any delay, due to any reasons, in the payments made through banks or through any online methods to first party bank accounts, farmer or owner of the commodities, or any others related to first party are expected cooperate amicably with FALCA solutions to resolve the issue. FALCA ensures, and it is sole responsible for the payments to be made to farmer for commodity sold.

If farmer or owner of the commodities, or any others related to first party tried to influence or bribe the FALCA representatives in anytime or during the time of inspection, loading or while making payments etc., will be subjected to FALCA solutions decisions to take further course of actions. Once commodities were auctioned as per FALCA procedures, farmer or owner of the commodities, or any others related to first party are not supposed to alter the quality or quantity of the commodities. If found guilty or suspicious then it will be at FALCA sole discretion to cancel the trading or rebid or to take further course of actions. Once commodities were auctioned as per FALCA procedures, farmer or owner of the commodities, or any others related to first party denies to handover the commodities to FALCA then farmer or owner of the commodities should bear the cost incurred by FALCA in carrying out until that trading procedure, and should pay towards FALCA as decided by FALCA . Once commodities were auctioned as per FALCA procedures, farmer or owner of the commodities, or any others related to first party denies to handover the commodities to FALCA after FALCA made payments by means of cash or online mode, then farmer or first party will have to face court of law trials as initiated by FALCA . In addition to FALCA Its farmer’s responsibility to demand the bill for the commodities sold, once the transaction is over.

Personal data

During the registration in Oview we ask you to provide personal data which includes your name, birth date, gender, education level, location (city), language preference and/or other categories of personal data which Oview will decide to include in the future. Providing this personal data is optional, and it determines the amount of information in statistical reports the user will be able to see after responding to the survey questions; meaning; providing your personal data gives access to the corresponding aggregated data in the statistics reports. It is possible at any point to remove and/or add personal data, and that will immediately change the extent of access to the relevant statistical reports. We collect information from your mobile device about the system and model of your device, version of your operating system, and statistical information about the equipment of your device such as the processor, short-term memory, internal memory, application versions and similar. This information could be used as statistical data for improvement of our system including security policies, but not limited to it alone. You can use third party services (such as Facebook and others) to share personal data while creating an account in Oview. Only personal data with public access will be collected in the case of using third party services. Oview does not have direct or indirect intention to collect more personal data than we ask of you during the registration. You can manage the information that we collect through third party services by changing the extent of public access to your personal data in those services according to their Privacy Policies.

Users rights

You have the right to know what kind of information related to you is being processed by Oview, and/or whether your personal data is being processed or not. You have the right to send a request to Oview in order to correct, supplement, delete or block information related to you according to your specification based on legitimate grounds.

Confidentiality and security

FALCA has implemented processes intended to protect user information and maintain security of data. It is each user’s responsibility to protect the security of his or her login information. We have attempted to protect FALCA'S servers by locating in them areas with security procedures, using of firewalls and implementing other generally available security technologies.
